Mi Coin Terms of Service
Foreword
These Terms of Service ("Terms") apply to Mi Coins and related services ("Coins") provided by Xiaomi Inc.
("Xiaomi"). These Terms constitute a legally binding agreement between the user ("you") and Xiaomi. By using
Coins, you acknowledge that you have read, understand, and agree to the Terms below.
We may modify these terms or any additional terms that apply to Mi Coins. We’ll post notice of modifications to
these terms on this page and in the related applications. Before using any of Xiaomi's services ("Services"), you
should read the related Terms of Service carefully. If you do not agree to the modified Terms of Service, you should
discontinue your use of that Service immediately.
Using Coins
Coins can only be used to purchase digital goods (for example, Games, Themes, and eBooks) and value-added services
provided by Xiaomi. The price of 1 Mi Coin is fixed at 1 RMB.
Coins may be purchased using RMB. You can purchase Coins for your own Mi Account ("Account") or for another
user's Account, after which they can be spent. You must use channels verified by Xiaomi to purchase Coins,
including but not limited to: Online banking clients, third-party payment clients (WeChat, Alipay), or mobile top-up
cards.
- You acknowledge that you can only use channels verified by Xiaomi to purchase Coins. Do not purchase Coins
through unverified channels (for example, Coins that have been illegally obtained from other users). Xiaomi
reserves the right to suspend the use of Coins that have been obtained through illicit channels. Xiaomi
reserves the right to pursue legal action against users who obtain Coins by illicitly using other users'
identities.
- You acknowledge that once you purchase goods or services using Coins (tax receipts available), they cannot be
returned unless they contain a critical flaw which renders them unusable.
- You acknowledge that unused Coins will be stored in your Account. If Xiaomi discontinues the Coins service
you will receive 60 days advanced notice. Unused Coins can be refunded according to their value at the time of
purchase.
- You acknowledge that you are solely responsible for your actions when you purchase Coins. Xiaomi is not
responsible for financial losses or indirect, special, consequential, exemplary or punitive damages in the event
of user error (for example, entering the incorrect Mi Account ID, or entering the incorrect amount of Coins
during purchase).
- If the purchase of Coins fails due to system error and user has adequate documentation of said error, in cases
where the amount of Coins delivered is less than the amount purchased, Xiaomi will compensate user for the
difference. Xiaomi reserves the right to reclaim Coins in cases where the amount delivered exceeds the amount
purchased.
- You acknowledge that your Account password can also be used to spend Coins. Please keep your Account password
secure. If there is suspicious activity associated with your Account (for example, Account password is reset),
Xiaomi reserves the right to verify your identity using the phone number and email address associated with your
Account. As it is exceedingly difficult to verify the validity of this information, we do not make any
guarantees regarding the results of our verification.
- You can use the phone number or email address associated with your Account to suspend or delete your Account at
any time. Xiaomi is not responsible for any financial losses or indirect, special, consequential, exemplary or
punitive damages that occur as a result of failure on the part of the user to expediently suspend or delete an
Account after it has been jeopardized.
Liability for our Services
You acknowledge that Xiaomi is not responsible for financial losses or indirect, special, consequential, exemplary or
punitive damages under the following circumstances:
- Hurricanes, earthquakes, tsunamis, floods, power outages, war, terrorist attacks, or other uncontrollable
occurrences prevent Xiaomi's services from working normally.
- Cyber attacks or adjustment or failure of technologies operated by telecom companies inhibit services provided
by Xiaomi.
- Government injunctions, legal changes, or injunctions from legal entities inhibit services provided by Xiaomi.
- User tells Account password to an unauthorized third-party or fails to adequately protect password security.
- Disputes arising from leaked bank account information caused by Xiami or other partner websites (for example, an
online banking client).
- Users (including minors) provide incorrect, incomplete, or inaccurate information when creating an Account leads
to users not being able to use Coins or other losses.
- If Xiaomi's service is temporarily closed for maintenance or updates, Xiaomi will notify users as soon as
possible. Xiaomi assumes no responsibility for your losses or the losses of any third-party that occur as a
result of disruptions to the Coins service.
Breach of contract
Xiaomi reserves the right to pursue legal action against users who breach any clause or agreement stipulated in these
Terms.
Legal dispute resolution
The interpretation and execution of these Terms will be done in accordance with the law in People's Republic of
China. Both parties should first attempt to amicably resolve any disputes that arise as a result of these Terms. If
the dispute is not resolved within 30 days after initial written notice is given, both parties reserve the right to
appeal to the Beijing Court System.
Privacy Policy
Your data is always treated in accordance with our Privacy Policies. Our Privacy Policy applies to these Terms.
Additional comments
- All notifications discussed in these Terms will be given via in-app notifications, emails, or other methods.
Said notifications will be deemed to be delivered on the day they are sent.
- These terms constitute a comprehensive Agreement between Xiaomi and you with regards to Coins and related
matters. Parties are not granted any rights outside of those explicitly stated in the Terms.
- If any condition in these Terms is partially or entirely unenforceable, it does not affect the efficacy of any
other conditions in the Terms.
- Titles are provided to make the Terms easier to read and do not have any special legal or contractual
significance.
